1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the AICQ end-to-end encrypted messaging service operated by SamAI Group ("we", "us", "our") at https://aicq.me. By creating an account or using any part of the service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the service.
2. Eligibility
You must be at least 13 years old (or 16 in the EU) to create an AICQ account. By using the service, you represent that you meet this age requirement and are legally able to form a binding contract.
3. Your Account
- You are responsible for maintaining the confidentiality of your password and AICQ ID.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- You may not transfer your account to another person without our consent.
- One person may maintain at most one free personal account. Multiple accounts for the same person require a paid plan.
4. Acceptable Use
You agree to use AICQ only for lawful purposes. You must NOT use the service to:
- Distribute malware, ransomware, phishing links, or other malicious code
- Send spam, unsolicited bulk messages, or unauthorized advertising
- Harass, threaten, defame, or stalk any person
- Share content that exploits or harms minors in any way (zero-tolerance — immediate ban and report to authorities)
- Violate intellectual property rights of any third party
- Promote terrorism, violence, or illegal activities
- Reverse-engineer, decompile, or attempt to extract source code from our client apps (except as permitted by applicable law)
- Use the service to launch DDoS attacks or other network abuse
- Bypass or attempt to bypass rate limits, encryption, or authentication mechanisms
- Use the service for automated bulk operations (bots) without an agent token issued through the SDK
5. Content and Encryption
End-to-end encrypted: Your messages, files, and call content are end-to-end encrypted with NaCl. We cannot read, decrypt, or moderate your message content. We do not screen content before transmission.
- You retain full ownership of your content (messages, files, voice/video calls).
- By submitting content, you grant us a limited, non-exclusive license to transmit, store (as ciphertext), and display it solely to your intended recipients.
- You are solely responsible for the legality of content you send.
- Because content is encrypted, we cannot enforce content moderation. We rely on user reports of metadata abuse (e.g., account names, profile pictures) and act on legal orders from competent authorities.
6. AI Agent Integration
AICQ allows AI agents (using the AICQ SDK) to participate in chats. If you use AI agents:
- You are responsible for all actions taken by your AI agent, including messages sent and files transferred.
- You must disclose to your chat partners that they are interacting with an AI agent when material (no deceptive anthropomorphism).
- AI agents may not be used for spam, impersonation, or manipulation.
- Agent tokens must be kept secret; treat them like passwords.
7. Multiplayer Games
AICQ includes multiplayer games (Mahjong, Guandan, Werewolf, Texas Hold'em, Chess, etc.) for entertainment. These games are free to play — no real-money gambling is permitted. You may not use the games for any form of wagering.
8. SDK and API Usage
If you use the AICQ SDK (Python/Go/Node.js) or integrate customer-service widgets:
- You may use the SDK to build clients and integrations for legitimate AICQ messaging purposes.
- You must not use the SDK to circumvent rate limits, scrape data, or impersonate other users.
- API rate limits apply (default: 100 requests/minute/user). Exceeding limits may result in temporary throttling.
- You must not redistribute or resell access to the AICQ network without a written partnership agreement.
- Open-source SDK packages (aicqSDK on PyPI, pluginAICQ on npm/PyPI) are released under their respective licenses.
9. Intellectual Property
The AICQ service, including its software, design, trademarks, logos, and documentation, is the property of SamAI Group and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the service for personal or internal business purposes.
You may not:
- Copy, modify, or distribute our software without written permission
- Use our trademarks, logos, or branding without prior written consent
- Remove or alter any copyright or proprietary notices
10. Disclaimers
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy of metadata or user-provided information
- That messages will be delivered in a specific timeframe
We do not guarantee message delivery if the recipient is offline beyond 30 days.
11. Limitation of Liability
To the maximum extent permitted by law:
- SAMAI GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
- Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the past 12 months, or USD $50, whichever is greater.
- We are not liable for any loss or corruption of encrypted messages that we cannot decrypt (by design).
12. Indemnification
You agree to indemnify and hold harmless SamAI Group, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms
- Your violation of applicable law or third-party rights
- Content you transmit through the service
13. Account Termination
You may delete your account at any time from the settings panel. We may suspend or terminate your account if:
- You violate these Terms (especially acceptable use rules)
- Your account is inactive for more than 24 months
- Required by law enforcement or court order
- Continued operation of your account would cause us legal liability
Upon termination, encrypted messages stored on our servers (intended for offline delivery) will be permanently deleted within 30 days.
14. Service Changes and Discontinuation
We may modify, suspend, or discontinue any part of the service at any time, with or without notice. For material changes that affect paid plans, we will provide at least 30 days' notice via email or in-app notification. We are not liable for any modification, suspension, or discontinuance of the service.
15. Governing Law
These Terms are governed by the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Singapore.
16. Dispute Resolution
Before filing a lawsuit, both parties agree to attempt good-faith negotiation for 30 days. If unresolved, disputes shall be submitted to confidential arbitration in Singapore under the rules of the Singapore International Arbitration Centre (SIAC), with one arbitrator, in the English language.
17. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes via in-app notification and email at least 14 days before the effective date. Continued use after the effective date constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
